Terms of Service

Use of the CarpTimer app ("the App") implies acceptance of these terms. If you do not agree, please do not use the App.

The App is provided by SC SOFTHARDEXPERT SRL, registration number 33764586, with registered office in com. Perieni, Vaslui county, Romania ("the Provider", "we"). Contact: office@carptimer.ro.

1. About the app

CarpTimer is a mobile app for carp anglers, providing per-rod cast timers, session journal, tactical map, and cloud sync. Core functionality is free, with an optional paid option for extended sessions (PRO subscription) — detailed in section 5.

2. User account

• You can sign up via email + password or Google Sign-In.
• You are responsible for keeping your account credentials secure.
• Single-device policy: only one device connected per account at a time. Signing in on another phone automatically signs out the previous one.

3. User-generated content (lakes and swims)

You may propose lakes and swims for the shared database. These are visible only to you until approved by a moderator. We reserve the right to:

• Approve, reject, edit, or delete submissions.
• Remove content deemed inappropriate (spam, vulgar, false, duplicate).
• Consolidate duplicate submissions into a single canonical lake.

Your personal fishing data (sessions, casts) remains private and visible only to you.

4. Acceptable use

You agree not to:

• Use the App for illegal or harmful purposes.
• Add false, offensive, defamatory content or content that violates others' rights.
• Attempt to access accounts or data that do not belong to you.
• Reverse-engineer, decompile, or modify the App.
• Use the App to automatically collect data (scraping).

5. Paid services (PRO subscription)

The App offers one optional paid service: the PRO subscription.

5.1 PRO subscription

• Covers unlimited sessions of any duration while active.
• Duration and price are shown at the time of purchase, before confirmation.
• A subscription purchased on the website does not renew automatically. A subscription purchased in the iOS app renews automatically and can be cancelled at any time from Settings › Apple ID › Subscriptions.
• The monthly subscription covers sessions created while it is active. The annual subscription additionally unlocks, permanently, the free sessions created before it.

5.2 Payment methods

We accept Visa and Mastercard (debit/credit). Payments made on the website are processed by NETOPIA Payments (netopia-payments.com), an authorized payment processor regulated by the National Bank of Romania. Purchases made in the iOS app are processed through the App Store, under Apple's terms. CarpTimer does not store your bank card details — these are transmitted directly to the processor via secure redirect (HTTPS / TLS 1.3).

The fiscal invoice is issued automatically using your account details and sent by email within 24 hours of payment confirmation.

5.3 Delivery and activation

The product is digital: the PRO subscription. Delivery is instant and free, no shipping cost.

• The PRO subscription activates instantly upon payment confirmation.
• You will receive payment confirmation and the fiscal invoice as PDF via email (within 24h).

6. Refund policy (right of withdrawal)

Pursuant to EU Directive 2011/83 on consumer rights, you have the right to withdraw from the contract within 14 days of purchase, if you have not used the service.

6.1 Refund conditions

• Subscription: refund accepted if no session has been created during the subscription validity period.
• The request must be submitted within 14 calendar days of the payment date.
• For purchases made in the iOS app, refund requests are handled by Apple through the App Store (reportaproblem.apple.com), under Apple's policy.

6.2 Cases where refund is not granted

• You used the subscription (at least one session created in the period).
• More than 14 days have passed since purchase.

This exclusion is in accordance with Article 16(m) of Directive 2011/83/EU — digital services performed in full or in part with the explicit consent of the consumer.

6.3 Procedure

• Send an email to office@carptimer.ro with the subject "Refund request".
• Include in the email: your account name/email, payment date, amount, reason.
• We respond within 5 working days with the decision.
• If approved, the refund is issued to the original payment method (card used) within 14 working days.

7. Limitation of liability

The App is provided "as is", without warranties of any kind. We are not liable for:

• Data loss due to technical issues with your device, network, or server (though we do our best to prevent this).
• Decisions made based on displayed data (locations, weather conditions, etc.).
• Content submitted by other users (lakes, swims).
• Issues caused by use of the App in conditions that don't comply with local law (e.g., fishing without a permit).

8. Service interruptions

We may temporarily stop service for maintenance, updates, or technical reasons. We will try to minimize downtime and announce it if planned.

9. Changes to these terms

We may update these terms occasionally. Changes take effect once published on this page. For changes affecting paid services (price, refund, subscription), we will send email notification at least 30 days in advance. Continued use of the App after changes means you accept the new terms.

10. Account termination

You can delete your account at any time from within the app (Account Settings → Delete account) or by emailing office@carptimer.ro. Upon deletion, your sessions are anonymized (kept without your ID for aggregate statistics). An active subscription is forfeited without refund.

We may suspend or delete accounts that violate these terms, with prior notice where possible.

11. Applicable law and dispute resolution

These terms are governed by Romanian law. Disputes will first be addressed amicably by email; if no resolution is reached within 30 days, you have multiple resolution paths:

• SAL (Alternative Dispute Resolution) — Romanian National Authority for Consumer Protection: anpc.ro/ce-este-sal
• ODR (Online Dispute Resolution) — European Commission platform: ec.europa.eu/consumers/odr
• Court of law — competent courts in Vaslui county, Romania
